Behind on Spousal Support

Dear april_hunt74:

Greetings. For post separation support, it is the payee’s responsibility to let the court know if payments are behind. The format for letting the court know is usually a Motion to Show Cause. The court does not keep track of what payments are made and which are not in post separation support. Best of luck.

The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.

The order states that it was to be paid weekly starting 8-13, but due to cicumstances, the first payment could not be made until 8-27. Is there a certain # of weeks they will “let you” fall behind before you are charged with contempt?
