When calculating over night totals is vacation time included? We are settling visitation now after being separated for 18 months. If the custody agreement says that each party has 14 days of vacation time per year is that included in the overnight calculation even thought the vacation time may never be used or exercised. Also is Holiday over nights included as well?

Also if we have 2 children and one child stays and over night with me (I have primary custody) and one spend the same night with the other parent is that overnight added to his total over nights.

You should try to calculate the number of overnights as accurately as possible under the custody provisions. That would mean including vacations and holidays into the calculation. If someone isn’t exercising visitation, the child custody order should be modified to reflect the visitation that is actually occurring.
