Court Order payment arrangements

Prior to my divorce, I did not receive my spousal support on a monthly basis. As part of my divorce order, my ex-husband has to check with the VA to see if automatic payments can be established electronically. Do you know if this payment option is available within the VA system? If so, how can I ensure it’s enforced. The judge stated if he violates the order, grounds for arrest can be issued. What is the process for that if I have to file.

You will need to contact the VA about the question regarding payments.

If someone willfully violates a court order, they can be held in contempt of court. Jail time is one consequence of violating a court order.

If your ex-husband violates the court order, you would need to file a motion for order to appear and show cause and state what he violated. The court will then review it and if the court agrees, the judge will issue an order to appear and show cause which would require your ex-husband to come to court and explain why he should not be held in contempt of court.
