I have a 14 (almost 15) year old daughter. I divorced her father about 2 years ago. Neither one of us has any kind of custody agreement or order on paper. My ex lives in NY and has not had any contact with my daughter since. I have always been her caregiver. My current husband wants to adopt my daughter. What would we need to do to make that happen? Does my ex have any parental rights to her? He does not pay child support.
Your ex does indeed still have parental rights and therefore you would have to move to terminate your ex’s parental rights by filing with the juvenile court. I do not practice in that area of law and would suggest that you consult with an attorney who specializes in termination and adoption cases.
