Husband wanted a separation but come to find out there was another woman. Why should I have to give up our kids 50% of the time so he can have joint custody, when it was him that wanted out?
Child custody in North Carolina is determined by the best interests of the minor children. It is not determined by who wanted to separate or similar factors. The Court may consider marital misconduct by the parties if such conduct affects the welfare of the minor children. There are many factors the Court may consider to determine what custody arrangement is in the best interests of the minor children.
