Custody questions/child choice

A father with a 50B that I was talked into dropping, two episodes of being held in mental health facilities, our daughter is 9 and is afraid of him and says she’d rather die than ever be alone with him, if we are to divorce, is there any chance that I will get sole custody and she won’t be forced to be around him? She has panic attacks when she thinks he is close to coming over. She won’t do well having to stay with him. Please help! Any advice is appreciated!

You will likely have a strong argument for primary custody with limited visitation with the father. Mental health facility records for the father, therapist records and therapist testimony for your child, and your own testimony about what you see and notice when the topic of being alone with her father comes up will be vital in court to prove your argument.
