Do I have to have a separation agreement?

My husband wants me to sign a separation agreement. Do I have to? Can we be legally separated without one? Or will I need to have a lawyer go over it before I sign?

You are legally separated as soon as you begin living separate and apart; you do not need a separation agreement in place to be legally separated. Before you sign anything your husband has presented you with, I would highly encourage you to consult with an attorney in your county so he or she can review the agreement and counsel you on the implications of the proposed separation agreement. Once since, the agreement is binding and it’s terms are enforceable so it is important to understand all of the terms you are agreeing to.
