I think what I’m asking is do I have to file a formal written response in the court prior to the hearing which is thursday afternoon. Is it possible to have my 8 year old daughter testify.
If it is a domestic violence restraining order you do not need to file a written reply. As for the testimony of your daughter, children under 18 are not allowed in the DV courtrooms. You may request that the judge speak to your child in chambers, however normally judges will refuse to involve such young children in these matters.
