Firing a lawyer

I guess it would really help if I gave the state sorry about that…we are currently in TN and all procedings are occuring in TN.

Simply advise the lawyer that you wish to terminate their services (at least that’s how we do it in NC). The lawyer will then withdraw from the case and you will be on your own. Good luck.

The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.

I know that this site says North Carolina but since you are close I am really hoping you can help…my fiance has been trying to get a divorce for the last 5 years. We are currently on divorce number 3. Our lawyer that we have is allowing this case to continue to drag along and we have had it. We hired the lawyer in March and NOTHING has been done. We handled the first 2 divorces pro-se and they got nowhere as well since his ex is in no hurry to finish it. But how exactly can we go about firing the lawyer we currently have since they are useless and go back to representing ourself (hisself?) I have several times caught the lawyer not following the local rules for civil practice in the area and each time I catch him he always asks how do I know the rules?? Why is he so concerned with me watching him instead of actually doing his job is beyond me completely!! We gave him a small retainer of only 1,000 and it’s all gone and he expects another 600 just in services already rendered!!! We can’t afford this crap and he’s about to let her attorney screw us even more!! She expects us to pay HER legal fees even though it’s her fault this has dragged out so long!! Help please!! What exactly do we need to file to get rid of the lawyer?? I can type up the legal documents myself and help my fiance prep for court a lot better than the lawyer we have can and we can’t afford another retainer for a different lawyer so we are sitting still spinning our wheels!!!
