How to file for divorce of bed and board?

#1

Hello, I understand the specifics (what it means and that it may or may not be granted) of a divorce of bed and board when one party will not leave, but it is unclear who can actually file. Can you answer how this process is started and approximately how long it takes for a judge to rule?
Specifically, does an attorney have to file or can an individual file?
Thank you!

You can always represent yourself pro se in court without an attorney. Any party can file an action for divorce from bed and board if they meet the statutory requirements. How long it takes a party to obtain a hearing and an order really depend on the calendaring system in your jurisdiction. In some counties, it takes months to get into court and others you can have a hearing fairly quickly.
