The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.

My brother is in the USMC. He is currently stationed in NC. His wife & him have been married for 3years and have 1 child together. She has told him she is stillin love w/her ex husband and wants to go back to him. My brother has tried to get her to go to marriage counseling and she refuses. The ex husband her have phone converstions and chat online. My brother has asked her to stop because they are still married. She refuses. He is so torn up and doesn’t knwo how to proceed with gettting a divorce. Does he have to file seperation papers first or what? ANy help would be greatly appreciated!
