Modification court date

I’ll try to sum this up in a few words as possible…
My ex has a date for modification. He is 25,000 in the arrears. He has paid what is court ordered 1 year out of 6. He paid less than half of what he is supposed to pay and 0 this month. Since he has a date to modify can I still file a contempt order?

Sorry… less than half last month and 0 this month. He was just held in contempt in may.

Yes, you can still file a contempt motion (called a motion for an order to appear and show cause). You could set the contempt motion on the same court date as the motion to modify.
