Out-of-State Visitation Guidelines

I am assuming your husban has 50/50 custody? A few things to hammer out… dates, who is providing transportation, who is paying transportation expense… what happens with “days” lost due to scheduling conflicts. You do realize that your husband can file for sloe custody if she chooss to move that far away. As far as I know, there is no “standard” visitation schedule for “out of state” visitation.

There is no standard schedule, the court will try to put in place a schedule that promotes as much visitation as possible. Generally, the parent with secondary physical custody will get more time in the summer.

My husband shares custody with his ex-wife of their two daughters. She is planning to move out of state and wants to come up with a visitation schedule to take to the judge that has been mutually agreed upon. What are the current NC guidelines/recommendations for out-of-state visitation? The proposed location for the new home for the girls is 12 hours solid driving time from where we are now. Currently, there is an order for her not to move out of the state of NC. She is moving to finish her education, and we support that, we just don’t want to give up any more time with the girls than we absolutely have to. Just trying to keep everything fair. I would appreciate any sort of advice/reference/link.

Thanks!
