Husband has deed to property and trailor on property. I do not believe it was done legally, was to be signed by previous wife, to turn over to husband. Question is, everything that is now on property, which includes house I am now living in, all came after we were married. Does that make everything his since it is on his property or can it be separated? Also, since he moved out of the house, do I have any legal way to claim it in the separation papers?
Property acquired during the marriage is marital in nature and will be divided.
If one spouse leaves the home the other party has the right to exclusive possession of the house pending distribution (by a court or by agreement), but leaving the home does not mean the other party relinquished their ownership rights I the same.
