Dear JDH0303:
Greetings. Please photograph everything and get immediate estimates of the damage. Then, your father should file an equitable distribution claim. He can have her compensate him for the damages and obtain a return of his property which was separate. Best of luck.

Ok…my dad just recently came home to find that my step-mom had cleaned out their house and bank account. This is not the first time that she has up and left while leaving him with little to nothing. I wanted to find out if they was anyway that he can sue her or prosecute her to get some of the belongings that were his mother’s that she stole from him. I know that if a marriage dissolves that items are suppose to be split equally…my dad and I both don’t care about the items she took other than the things that were his mother’s and of course the money that she stole. The money came out of a joint checking account and I know that means she has the right to withdraw from it but she wasn’t contributing anything to the household because she has been out of work for over three years and has just recently in the past few months started pulling social security. What can we do if anything? I forgot to mention that before leaving she also vandalized the house by spraying soda onto some of the walls and dumping a fish tank out into the living room, my dad has not done anything to provoke this and hasn’t even had an argument with her in a long while.
Thank you,
Danielle
