is it considered neglect or child endangerment to allow a 3 year old to go swimming in 63 water temp all together but even more so when that child had been sick and recovering from a bad cold and cough!? luckily no harm was done but that’s beside the point.

A neglected juvenile is defined as a juvenile who does not receive proper care, supervision, or discipline from the juvenile’s parent, guardian, custodian, or caretaker; or who has been abandoned; or who is not provided necessary medical care; or who is not provided necessary remedial care; or who lives in an environment injurious to the juvenile’s welfare; or who has been placed for care or adoption in violation of law.

Whether that would be considered child neglect is a determination for the court to make, but it is my experience that it requires more than a showing of a single instance of swimming in cold water.
