I filed a restraining order and equitable distribution. Her attorney file a motion to dismiss, because we are not separated yet you can’t file equitable distribution.

If the case is dismissed I have no way of stopping her from moving everything. Can I file another restraining order only to stop her from moving everything? Everything is still packed.

The complaint we file (Equitable Distribution/Temporary Restraining Order). Can I file another complaint for just Temporary Restraining Order?

If I do file a restraining order can I file the order while she is out of town? The items are packed, can I refile the restraining order?

The restraining order is part of the property action and cannot stand if that action has been dismissed.

You must move out before the action will stand.
