Separation & Pregnancy

Me and my ex are currently going through a divorce. we have been separated (with no contact) since july 2018, but didnt file papers until August 7th, 2020. I finally filed the paperwork because I am pregnant with a little boy and the child is not my exes, the biological father is my boyfriend… AND My ex knows I am pregnant due to facebook. Anyways, since the divorce wont be finalized before the child is born, my ex will be presumed the legal father. how do i revoke those rights? and can i do it before baby is born so that my boyfriend can sign the birth certificate & affidavit ??

After the child is born, you will have to pursue a legitimation proceeding for the biological father to be considered the father.

will biological father be able to fill out the parental affidavit?

Yes, the biological father is the one to initiate the legitimation proceeding.
