It depends on whether or not they were married in Germany and intend to file for separation/divorce in Germany.
They were married in north carolina and from what I know is they both would like to get a divorce.
Very much so, and I would suspect that she has abandoned him. He can file for separation and even ask for an emergency injunction to bring the child back to where he can visit with him–though if she’s been gone for five months, maybe he doesn’t care…which is sad. That would cripple his argument.
I wouldn’t even begin to suggest fighting an international divorce, talk about expensive. If he doesn’t care, then let him request what he needs and move on. Fighting a lost battle takes a lot of time, energy and money, and that is his decision to make.
