If the two of you can’t agree to modify the dates set forth in the order then it is probably best to stick with the schedule that is written in the original order.

I believe in the rest of your question you are asking if you can withhold visitation if your child is sick, is that correct?

I have an issue that seems to be getting out of control. We went to court about two months ago. STBX was suppose to have the children in Sept but opt not to. Now he is to have them Nov for two weeks. I have told him that it should start Nov 8th and con’t to Nov 22nd. During that time frame is also his birthday. The order didn’t state what days or times.

Also I was going to be nice and let him have them for an extra two weeks because he didn’t want them in Sept. Attorney said He should have gotten them during that time and I don’t have to let that happened. So, I am not going to. Well he wants them from Mid Nov til January 1st. Where did 2 weeks go to a month and a half. I am lost at this.

We have a 2 yr old plus a child who will be 1 this week. The STBX is out of state and that is going to be one long drive for the children. The paperwork doesn’t state that they have to leave NC and also doesn’t state that they have to stay here. It is only a temp order. Two months when we went to court our baby streamed because she doesn’t know him. He didn’t want to keep her over night to spend time with her because she was screaming. I would like to know if she does this again, do i have to let her go? Our 2 yr old was 1 at the time and he screamed so bad on the trip to where he lives now and pretty much during that whole time there on vacation he ran a very high fever and was sick. I am scared she would do the same. Plus she is a baby and I wasn’t the one who left NC.
