I know you are supposed to live apart for one year, but, do they check? We have no possessions together, besides a house, no kids , it will NOT be contested by either party,would like to file as soon as the house closes. but we havent been separated a year. We are very anxious to get this behind us and move forward. Question is do they check whether you have been living apart for the year?
The court does not have means to check your date of separation. When you sign the complaint and testify in court, you are perjuring yourself if you lie and tell the court an incorrect separation date.
