Divorce and the house

#1

Hmmm…that is a weird situation. When he comes back in 3 years he wants to come and live with you? That will not fly with the judge. One of you will get the house. Most likely the one who also gets custody of the child. A lot can change in 3 years and I do not see how he thinks it would be okay for him to just come back and live there. Also, if he is agreeing to anything, you need to get him to sign it in front of a notary or get an attorney and get a seperation agreement.

Good Luck!

Dear apjones:

Greetings. If you don’t want someone to come and live with you that has been out of the house for 3 years, then you tell them so, write them a letter, and if they come back you go to the magistrate and have them charged with domestic criminal trespass. Thank you.

My husband had an 8 month affair. I tried to get over it, but have decided that I cannot and want out of the marriage. We purchased a home and have a 7 year old child. He is in the military and leaving for three years. I told him that I wanted a divorce and he stated I can have anything that I want but he is living in the house with me and my son upon his return. He agreed to pay me $500 a month for child support. I have been paying on the mortgage alone. I do not want to uproot my son.
How can I keep the house. I do not want him to pay anything on it, I just do not want my child to go through anymore unnecessary change.
