Can judges consider a psychiatry medical opinion in a custody case? My personal psychiatrist is recommending that I move close to family for support with my children. It is a doctor that is treating me for stress. Will this be a negative or positive factor? Can I present this written medical information to the judge during my trial?
You can present the evidence at trial, and depending on the facts and the judge’s view of those facts it could be beneficial, or detrimental. I cannot predict how any one judge will react to different facts.
