I signed a waiver of summons. I thought i did not have to wait thirty days for him to get a notice of hearing for a court date since i waived the service and signed the waiver. But i have not gotten a notice of hearing and it has been a month. Could he be stalling or will they mail me a court date or does he have to file the hearing to get a court date and could he have done that immediately? He keeps telling me he is waiting for the court date.
If you did not sign a waiver of time to answer the court will not close the time for a responsive pleading until 30 days have passed. It does take some time after that as well to obtain a hearing date. Typically after the filing of a complaint it takes anywhere from 60 to 90 days for the judgment to be final.
