It is my understanding that if they other party will not sign it will just have to go to court. I understand what you're going through although I wasn't the one who cheated, but I think it's a case of them wanting us in their lives on their terms and we are supposed to just sit and take it. Hopefully you can get your case heard soon and me mine and we can get on with our lives and restore some semblace of balance and peace
I would like information on what groups are fighting to drop A of A lawsuits. Although I know there are some legitimate problems I tend to agree with hawkman. I am currently being sued for AA and what has happened is horrible. My wife (now) was married to a wealthy man who abused her both physically and mentally for years. There are even police reports, althought the pictures mysteriously dissapeared. She had hired a lawyer to prepare to leave and began working to enable her to support herself and her son (not his son). I met her soon as she left him but before she had divorce papers signed. The things he did to her and her son were horrible. He was running around on her and kept telling her to leave. She is an incredible woman and we fell in love and have been together three years. Her wealthy ex decided he wanted to get back at her. If you can imagine being horribly treated for years and then finally getting freedom and finding out how wonderful life truly can be, thinking everything is great and then get hit again by the man that abused you. She took it horribly and completely lost it feeling she was being abused again. The stress she felt was unbearable for her and she developed health problems that turned out to be Lupus. The Doctors said the stress triggered the lupus. Even worse the Lupus then attacked her brain (rare) and now she is brain damaged, cannot work or drive. When it first attacked we almost lost her. She could not walk, talk, and was like a 1 year old. So screw AA suits! The suit is still on going and her ex thinks it is funny. He has money to burn and of course we do not. So does anyone know who is heading up the battle to drop AA suits in NC?
There is a 3 year statute of limitations on AofA. Seems you are past that date. I am sure there could be ligitimate reasons for AofA, but from what Ive read here, most are acts of revenge, madness or being hurt. Because we are in the ‘bible belt’ I believe that is why this suit has hung around for as long as it has and seems to always fail to be abolished. If you find out any info on groups, let me know. Maybe they need to refine the ‘guidelines’ for suing?

You can't be sued for AoA if they were already living apart.
It's funny to me how everyone wants to get rid of AoA suits but no one wants to stand up against adultry. Like I said before some cases deserve to be brought.
My X told me he was leaving in March 03 and didn’t actually leave until October 03. In June 03, I took my son to the beach for a week and put a voice activated tape recorder in my home. What I heard was another woman in my house and my X talking about being with a hooker! Now, he’S trying to stop alimony payments based on co-habitation, which is not true, and I am ready for the A of A suit against his new wife as of February 2007. When does the 3 year statue date for alienation begin? Can I use the tape recording in my suit against her?
I recently got a letter from a lawyer claiming that I would be persued for Alienation of Affection and Criminal Conversation if I didn’t respond within 14 days.
I would PREFER not to be berated or lectured on this topic. I am asking for advice. Yes, I had communications with this man and we socialized on occasion, yes we flirted. Yes, I knew he was married…but negotiating for a separation for several months before I started a ‘relationship’ (I read the proposed papers…they were dated) I also gave him some advice in that I had been divorced 5 years ago. Yes, I am very fond of him. Yes, what I did was wrong. My questions are:
Am I due any proof of evidence on the opposites behalf? Technically she can get me on the offering of advice and the socializing. For all I know she is going on suspicion and just going for the gold.
I really don’t want to be drawn into court. The STBX is angry…and I totally understand that. The man is still in the house…no separation papers have been signed and he has not moved out under previous advice from a lawyer.
I would appreciate advise-with no lecture please. I know I screwed up. Thanks.
