I hired an attorney to help me with my ongoing divorce. This attorney was not aggressive at all and just seemed to go along with whatever the opposing attorney wanted. I fired this attorney and have hired another who is much more aggressive in looking after my interests. I paid the first attorney several thousand dollars for a retainer. I have not received any accounting of where this money was spent and this has been going on for over a year. I’m sure he did not spend enough hours to use up all the retainer because he really didn’t do much but forward emails between me and the opposing attorney. Is it possible to get the remaining retainer back and if so what is the best way to do this?
You will have to contact your prior attorney directly about a refund. The NC State Bar also has fee dispute services if you cannot resolve this issue with the attorney.
