I am a Marine, have been married to a woman for 4 1/2 yrs & seperated(no papers filed) for 2 1/2. She walked out on me. After doing so I started seeing another woman about 6-7 months later. When my wife left she said she was pregnant. Due to my finding postings of her online for prostitution I was suspicious if it was my child. Being that we were seperated I didn’t see her during the alleged pregnancy. Come to find out there was no baby she was lying the whole time. Anyhow, I have another child by my new girlfriend. My wife won’t sign the papers I sent to her when I was stationed in CA… she MOVED from her address to keep from signing so I cannot marry my girl. She is constantly threatening to get me in trouble with the military and I just want her outta my life with out having to use JAG. Is that possible? I have no attachments with her, no property, kids, dogs, plants or anything at all… we just have the same last name. The girl I’m with now is a good hearted, honest, hard working girl & she deserves better than this & is about to take my daughter & leave. Please give me any advice possible. Thanks!
If you have been separated for more than a year you can divorce her. If she is in another state, send a registered letter to where you think she is. If it can’t be delivered then you will have to publish something in the local news paper (where you think she lives). I don’t know about publishing on Craigs List. Maybe that is an option. Maybe one of the attorneys will chime in on that. I would guess after 30 days of no response you could simply file for D. She could not stop it.

If you live in NC you may file for divorce in this state, and there is nothing she needs to sign, and no way she can prevent the divorce from going through. There is a video on the website that describes the divorce process here in NC.
