Steps to filing a Civil Complaint

Each county handles this a bit differently. You will need to talk to someone in the clerks office for details in your county.

Good luck.

The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.

Thank you. I’ve tried talking to many of the Clerks employees but no one is willing to provide any information.

Basically, I would go to the courthouse and hang around until I got an answer. Sometimes dealing with government can be really frustrating. Sorry you are having difficulty.

I completely agree with you. Thanks for your input.

I am helping my brother file a civil complaint for visitation relief as he cannot afford an attorney. I have been using the SelfServe Center from nccourts.org but my next step in this process is unknown. We have successfully filed the complaint/summons and the Affidavit of process of service along with the green Return Receipt card. The Clerk’s office gave us a Calendar Request form and now we are lost. We aren’t sure where to get the Calendar information as a Judge isn’t automatically assigned to the cases in NC. If anyone could please help it would be greatly appreciated…
